Integrated Solid Waste Regulatory Framework Rulemaking
The purpose of this rulemaking is to establish a systematic and comprehensive framework for regulating solid waste facilities and solid waste streams in Arizona. This rulemaking will integrate and implement statutory provisions related to best management practices, self-certification requirements, plan approval procedures, financial assurance requirements, design and operation rules for solid waste facilities, and other topics. The types of facilities that may be affected by this rulemaking include landfills, treatment facilities, transfer facilities, on-site storage facilities, composting facilities, and recycling facilities. The rulemaking will also address the handling of solid waste prior to the point it is received by a solid waste facility.
On January 14, 2009, ADEQ filed a Notice of Proposed Rulemaking relating to solid waste facilities with the Secretary of State and provide stakeholder's an unofficial copy of the rule to be proposed. On January 22nd, Governor Brewer directed state agencies to temporarily stop all rulemaking activities to allow her new appointments to undertake a regulatory review. The Governor's directive also suspends informal rulemaking activity. On February 6, 2009, ADEQ published in the Administrative Register a Notice of Public Information indicating that the proposed rulemaking filed by ADEQ has been withdrawn.
